Our policies

Information we collect and receive about you

We may receive or collect several types of information about you, such as the information described below.

Information you provide

To book our services, purchase subscriptions or gift cards, or purchase certain other products, you must provide us with your information.  Specifically, to book our services, you must provide us with information about the services you are planning and provide us with additional information, including your first and last name, telephone number and email address. To purchase products in-store or online such as subscriptions, gift cards or other products, you must provide us with additional information, including your first and last name, email address, physical address and credit card number or other payment information.

Other situations in which you may provide us with your personal information include the following 

- When you fill in forms or fields via our Services ;
- When you buy a product from us;
- When you subscribe to newsletters or other documents through our Services;
- When you provide information to us through a third party application, service or website;
- When you communicate with us or request information about us or our Services, whether by e-mail or other means;
- When you participate in online surveys;
- When you participate in any of our marketing initiatives, including contests, events or promotions; and
- When you participate in forums or provide user-generated content or submissions.

 

Information provided by third parties

We may collect information about you from sources other than you, such as social media websites (i.e. Facebook, LinkedIn, Twitter or others), blogs, other users and our business partners.

General Usage and Preference Information
We may collect, receive and store information about your general use of our Services (such as details about how and when you used our Services, interactions with our Services, login information, resources you access, your IP address, browser type and device type) and your preferences.

 

Phone Numbers

We may collect your phone number in several ways.  For example, we may collect your telephone number: (i) if you submit your telephone number to us through our Services; (ii) by entering your telephone number if you call us; or (iii) if a third party provides us with your telephone number.

Cookies and anonymous identifiers

We and third parties use various technologies to collect and store information when you use our Services, including sending cookies, pixel tags or other anonymous identifiers to your device.  Cookies" are data stored on our computer, cell phone or other device.  A "pixel tag" is a type of technology placed on a website or e-mail for the purpose of tracking activity, which is often used in combination with cookies.  Other "anonymous identifiers" are random strings of characters used for the same purposes as cookies, for example, for mobile devices where cookie technology is not available.  These technologies help us to know that you are logged in, to provide features based on your preferences, to understand when you interact with our Services, and to compile other information about your use of our Services.

The information collected using these technologies cannot, by itself, be used to determine your identity.  This information may, however, be combined to become personally identifiable information (i.e., information that can identify you).  In this case, we will treat the combined information as personally identifiable information.

Please note that, in most cases, you can delete or block cookies (for example, by using your browser settings), but this may affect your ability to use our Services.

Membership Agreement and Payment Information

All members must complete a contract with DERMAGYMS. The contract contains (but is not limited to) full name, date of birth, phone number and email, address, credit card information. All contracts are filed in a locked and secure location. When the membership is terminated, the contract is filed and all payment information is deleted from our system.

How We Use Information

We may use your personal information for a variety of legitimate business purposes.  These purposes may include, but are not limited to, using your information for :
- Engage in customer support and conduct transactions. For example, we may confirm and complete transactions you have requested, verify the information you provide, and provide you with administrative notices.
- Contact you and provide you with information.  For example, we may provide or contact you by telephone, email, postal mail or other communications with Service updates, promotional materials, surveys, offers, personalized information and other information from us or our business partners.
- Analyze, improve and manage our services and operations.  For example, we may obtain feedback regarding our Services, understand and anticipate your needs and preferences, better understand your use of our Services, customize and tailor the content and advertising of our Services, improve our marketing and promotional efforts, perform statistical analysis and provide feedback to our suppliers, advertisers and other third parties.
- Resolve problems and disputes and address other legal and security issues. For example, we may use your personal information to comply with this Privacy Policy, any other applicable agreements or policies, to monitor compliance and enforcement, to meet other legal and regulatory requirements, and to protect the security and integrity of our Services.

How We Disclose Information

General disclosure of your personal information

We may disclose your personal information:
- To any person who, in our reasonable judgment, is authorized to receive your information as your agent, including by reason of your business relationship with that person (for example, your lawyer);
- To our third party suppliers to support our internal and business operations, including data processing, verification and storage, surveys, research, internal marketing, delivery of promotional, marketing and transaction materials, maintenance and security of our Services;
- To third parties when you engage in certain activities through our Services that they sponsor, such as purchasing products or services offered by a third party, choosing to receive information or communications from a third party, or choosing to participate in contests, sweepstakes, games or other programs sponsored, in whole or in part, by a third party;
- As required by law or as ordered by a court, regulatory or administrative body;

- If we deem it necessary, in our sole discretion, if we believe that you violate any applicable law, rule or regulation, or infringe on the rights or property of others, including, without limitation, our rights or property ;
- At the request of the authorities in the event of an act of terrorism or a local, regional or national emergency;
- To enforce this Privacy Policy and any other applicable agreements and policies;
- To enforce or protect our rights;
- As part of a business transfer, as defined below (see Business Transfers below); and
- To our affiliates (i.e. companies under common control or management with us).

Aggregation and depersonalization

We may take your information and de-personalize it by combining it with information about other individuals (by combining it with information about other individuals) or by removing features (such as your name) that make it personally identifiable to you (by de-personalizing your information). We reserve the right to share, loan, rent, lease, sell or disclose this information to third parties at any time, for any lawful purpose, without notice or compensation.

Draws
If you submit information to us as part of a sweepstakes, we reserve the right to share, lend, rent, sell or otherwise disclose the information you submit to third parties at any time, for any lawful purpose, without notice or compensation to you.  Please refer to the Official Rules and Privacy Policy of each draw for our specific policies regarding the sharing and disclosure of information in connection with that draw entry.

Bypassing security measures

In addition, we cannot guarantee that your information will only be disclosed in the manner described in this Privacy Policy.  For example (without limiting the foregoing), we may be forced to disclose your information to the government or third parties in certain circumstances or third parties may unlawfully intercept or access transmissions or private communications.  Therefore, notwithstanding anything to the contrary in this Privacy Policy, the Terms or any other applicable agreement or policy, your use of our Services is at your own risk and we do not promise or guarantee, and you should not expect, that your Information will always remain private.  In the event that an unauthorized third party compromises our security measures, we will not be liable for any damages caused directly or indirectly by the ability of an unauthorized third party to access, use or disseminate such Information.

 

Business Transfers
We expressly and specifically reserve the right to disclose, rent, sell, assign or transfer to third parties, as part of a business transfer, your personal information collected through our services and our databases, as well as any personally identifiable information contained therein.  A "transfer of business" means a sale, acquisition, merger, amalgamation, consolidation, reorganization, bankruptcy or other corporate change involving us and/or our affiliates, even if the transfer of business is contemplated for only part or all of our business.  Nothing in this Privacy Policy is intended to interfere with our ability to transfer all or part of our business, equity and/or assets (including our services) to an affiliate or independent third party at any time for legitimate purposes without notice or compensation to you.

 

Children's Information

Our Services are intended to be accessed and used only by adults and are not intended for minors.  We do not knowingly collect personally identifiable information from anyone under the age of 13, and you should not provide us with information about anyone under the age of 13.
